Liability Release & Assumption of Risk [免責と危険負担]

Thank you for hiring us for your transportation or for the arrangement of your transportation. Certain specific risks and dangers exists which are inherent in recreational activates in ocean, mountains, parks or other places. These risks include, but are not limited to, theft, loss of or damage to personal property, injury or fatality as a due to an accident, illness in remote places without medical facilities, and exposure to temperature extremes or inclement weather. Please read the following information carefully and sign where indicated

弊社を貴殿の交通手段として、あるいは交通手段の手配者としてご利用くださいまして有難うございます。海、山、公園やその他場所での娯楽活動にはそれぞれ固有で独自のリスクと危険が存在します。そのようなリスクには盗難、動産の喪失や破損、事故による怪我、死亡、医療設備がない遠隔地での病気、過激な温度や悪い天気に晒されることなどがありますので下記の事項を良く読み所定欄にサインしてください。

I, the undersigned hereby acknowledge that the services rendered by HRD Corporation dba lanikaitour.com are for transportation only. I understand that it does not implicitly or expressly warrant state or condition of your destination or lack of risks involved in my recreational activities.

HRDコーポレーション（商号ラニカイツアードットコム）からのサービスが交通手段に限られていることをここに私は認め下記に署名します。同社が娯楽活動に関する危険及び訪問地の環境状態を暗黙にも明示的にも保証していないことを理解しています。

I, the undersigned, hereby acknowledge that I fully understand that there are inherent risks in recreational activities (hiking, swimming, surfing, etc.). I understand that these risks are impossible to eliminate by even the most prudent and careful planning and conduct. I understand that participating in these activities entails unavoidable risk of loss of life, personal injury, illness, loss of consortium, and loss of or damage to personal property.

娯楽活動（ハイキング、水泳、サーフィン等）には固有の危険があることを下記署名した私は理解しています。充分に慎重で綿密な計画を立て行動をとっても全ての危険を排除しきれないことも理解しています。これらの娯楽活動に参加することにより生死、事故、病気、慰めの喪失、動産の喪失や破損など避けることのできない危険があることを理解しています。

I understand that I am to be financially responsible for any medical treatment and any necessary emergency evacuation resulting from recreational activates. I have been advised to consult with my (or my minor child’s) physician before engaging in recreational actives if there is any health concern.

娯楽活動による万一の事故等によってかかる医療費用や必要な救急に関する費用は私が支払負担すること理解しています。もし、健康に問題がある場合は事前に私の（あるいは私の子供の）主治医と相談し娯楽活動に参加するように忠告されました。 

I do expressly covenant and state that I (or my minor child) will assume all risks in said recreational activities for myself (and my minor child). I specifically release HRD Corporation, its officers, agents, employees, owners, and directors from any and all liability as to any right, action or claim to relief that may accrue to me or to my heirs or personal representatives for any such personal injury, loss of life, loss of consortium, or loss of or damage to property. The terms hereof shall serve as a release and express assumption of risk for myself, my heirs, executors and administrators and for all members of my family, including any minors accompanying me.

私は娯楽活動についての危険性について自分（あるいは私の未成年の子供）が責任を負うことをはっきりと約束します。人身事故、死亡、慰めの喪失、財産の喪失や破損により発生する私、私の相続人、相続財産管理人が有する権利、訴訟権、請求権に対しHRD コーポレーション、その役員、代理人、従業員、所有者、取締役を免責放免とする。ここにある条項は、私、私の相続人、相続財産の管理人、私に伴う未成年の子供を含む私の家族の構成員が免責放免し危険の責任をはっきりと負う効力を有するものである。

Any dispute that may arise out of this agreement or otherwise between the parties to which HRD Corporation or it agents is a party shall be resolved in Arbitration at Honolulu, Hawaii.

この合意書あるいはその他により生ずる紛争はホノルル・ハワイにて仲裁により解決する。
